HIV-ASSIST is an online, interactive, educational tool to inform clinical decision-making for ARV selection. Your access to and use of HIV-ASSIST ("We", "Our", "hivassist.com") is conditioned on your acceptance of and compliance with these Terms of Use. These Terms of Use apply to all visitors, users, and others ("Users") who access or use HIV-ASSIST. By accessing or using HIV-ASSIST, you ("User") agree to be bound by these Terms of Use. If you disagree with any part of the Terms of Use, then you may not access HIV-ASSIST.

No Warranties and Limitation of Liability

Although HIV-ASSIST strives to verify that contents are timely and accurate, Users understand that changes occur in standard of care, and HIV-ASSIST, its creators, authors, Board, Directors, and staff are not liable for omissions or errors, or for any damage or loss of any other kind involving clinician users or their patients. Users are encouraged to independently investigate content published in HIV-ASSIST. HIV-ASSIST is provided as distributed, without warranty, expressed or implied, and use of the information is at the risk of the User. You should never disregard medical advice or delay in seeking it because of something you have read on this site. IF YOU HAVE AN EMERGENCY, CALL 911.

HIV-ASSIST is intended for licensed healthcare providers and medical trainees for educational purposes only. The purpose of the website is to disseminate information related to the prevention, diagnosis, and treatment of medical diseases. Contents do not constitute medical advice or a treatment guide for patient care and should not be solely used to guide for clinical management. Users agree to use their own medical judgment to determine care and treatment for their patients. Users agree that information contained in HIV-ASSIST does not constitute advice about specific medical conditions or treatment, and patients are urged to contact a licensed medical practitioner with health questions or concerns. Users agree not to submit or store individually identifiable patient health information or data (Protected Health Information; PHI) as described by The Health Insurance Portability and Accountability Act of 1996 on HIV-ASSIST. No doctor-patient relationship results from use of HIV-ASSIST, and subscribers should not delay seeking medical attention based on HIV-ASSIST contents.

Funding

HIV-ASSIST is a non-profit organization with funding from a variety of sources. A volunteer Scientific Advisory Panel guides HIV-ASSIST algorithms and a list of names is published on the website. The Panel operates independently of any HIV-ASSIST funders. Algorithms and utility weights are the product of Scientific Advisory Panel's assessments, and are not contingent on any funding source. Products, medications, and devices mentioned in HIV-ASSIST are referenced for educational purposes only and are not endorsed by HIV-ASSIST, its creators, authors, Board, Directors, or staff. Clinicians and healthcare providers should consult standard clinical resources before prescribing medications to their patients.

Indemnification

Subscribers agree to defend, indemnify, and hold harmless HIV-ASSIST, its creators, authors, Board, Directors, and staff from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, resulting from, or alleged to result from, a User's use of HIV-ASSIST or breach of the Terms of Use.

Governing Law

Terms of Use Agreement is governed by the laws of the State of Maryland without regard to its conflict of laws rules. A subscriber expressly agrees that exclusive jurisdiction for any claim or dispute with HIV-ASSIST, its creators, authors, Board, Directors, or staff resides in the courts of Maryland, and further consent and agree to personal jurisdiction by the state and federal courts sitting in the State of Maryland in connection with any such dispute.

Copyright

Contents of HIV-ASSIST are provided to users in good faith for purposes of non-profit educational use. The content, in part or in total, has been provided pursuant to the doctrine of "Fair Use" as defined in United States copyright law. Subscribers agree to the requirements of "Fair Use," and unauthorized use applications may violate copyright, trademark, service mark, or other laws. Subscribers agree not to copy or adapt the HTML or other code used to generate website pages. Subscribers agree not to sell or modify contents without express permission of HIV-ASSIST.

Registration

Subscribers must provide true, accurate, and current information in the registration form and should make every effort to maintain the registration information current in the event of changes.

Privacy Policy

These Terms of Use incorporate the entirety of the HIV-ASSIST Privacy Policy.

Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use HIV-ASSIST after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using HIV-ASSIST.
